Welcome to Audit&Fix ("we", "us", "our"). By purchasing or using our website analysis service at www.auditandfix.com (the "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully.

Audit&Fix is operated as a sole trader business registered in New South Wales, Australia.

1. Service Description

1.1 What We Provide

We provide Conversion Rate Optimisation (CRO) analysis reports for websites. Our Service:

• Analyses your website's design, content, and user experience
• Generates a detailed PDF report with actionable recommendations
• Delivers the report via email within 24 hours of purchase

Our reports are generated using AI-powered analysis tools and reviewed by our team before delivery. The analysis methodology combines automated scoring with human quality assurance.

1.2 What We Do NOT Provide

• Implementation services – We provide recommendations only; you are responsible for making changes
• Professional advice – Reports are informational and educational, not professional consulting or legal advice
• Guaranteed results – We do not guarantee revenue increases, conversions, or specific outcomes
• Website hosting, development, or technical support

2. Eligibility

You must be at least 18 years old, authorised to enter binding contracts, and able to provide a valid email address for report delivery. By using the Service, you confirm you meet these requirements.

3. Purchasing the Service

3.1 Pricing

• The price is displayed in your local currency at checkout
• Prices are subject to change without notice; existing orders are honoured at purchase price

3.2 Payment

• Payments are processed securely via PayPal
• We accept credit cards, debit cards, and digital wallets supported by PayPal
• Payment is required upfront before analysis begins
• By providing payment, you authorise us to charge the displayed amount

3.3 Taxes

Prices are displayed inclusive of Australian GST (Goods and Services Tax) for Australian customers. Audit&Fix is registered for GST. International customers are not charged GST. You are responsible for any other taxes applicable in your jurisdiction (VAT, sales tax, etc.).

4. Report Delivery

4.1 Delivery Timeline

• Reports are typically delivered within 24 hours of purchase
• Delivery may be delayed by technical issues, high order volume, or website inaccessibility
• If delivery will exceed 24 hours from purchase, we will notify you via email with an updated timeline

4.2 Delivery Method

• Reports are sent as a PDF attachment to the email address you provide at checkout
• You are responsible for providing a valid, working email address
• Check your spam/junk folder if you don't receive the report
• If you haven't received your report within 24 hours, please contact us. We will re-send it or issue a full refund

4.3 Website Requirements

We can only analyse websites that are publicly accessible (not password-protected, private, or offline) and not designed to harm users or violate laws. If your website does not meet these requirements, see Section 5 (Refunds).

5. Refunds

5.1 Money-Back Guarantee

If you are not satisfied with your report, contact us within 30 days of delivery and we will issue a full refund — no questions asked. This guarantee is in addition to any statutory rights you have under applicable consumer protection laws, including the Australian Consumer Law.

As our reports are digital content delivered within the refund period, we begin processing immediately upon payment. By purchasing, you consent to immediate delivery and acknowledge that this does not affect your money-back guarantee rights described above.

5.2 Refunds Also Issued If

• We cannot deliver your report due to a technical failure on our end
• Your website is inaccessible or incompatible with our analysis tools
• A service outage prevents report generation

5.3 Requesting a Refund

• Notify us via our contact form within 30 days of delivery
• Include your order number
• We will review and respond within 5 business days
• Approved refunds are processed within 7–10 business days to your original payment method

6. Intellectual Property

6.1 Report Ownership

You own the analysis report we generate for your website. You may use it for your business purposes. You may not resell, redistribute, or publicly share the report, or claim authorship of our analysis.

6.2 Our Intellectual Property

All content on www.auditandfix.com (text, graphics, logos, software, methodology) is owned by Audit&Fix and protected by Australian copyright law (Copyright Act 1968) and international treaties. Unauthorised use is prohibited.

7. Disclaimer of Warranties

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any right, remedy, guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010) or any other applicable consumer protection law that cannot lawfully be excluded or limited.

Subject to the above, and to the extent permitted by law, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND BEYOND THOSE EXPRESSLY STATED IN THESE TERMS. WE DO NOT WARRANT THAT EVERY RECOMMENDATION WILL BE APPLICABLE TO YOUR SPECIFIC BUSINESS CIRCUMSTANCES. WE DO NOT GUARANTEE INCREASED CONVERSIONS, REVENUE, OR ANY SPECIFIC OUTCOME FROM IMPLEMENTING OUR RECOMMENDATIONS.

Our reports are educational and informational, not professional consulting. You are solely responsible for evaluating whether recommendations are suitable for your business.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY LOST PROFITS, REVENUE, DATA LOSS, OR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE OR RELIANCE ON OUR REPORTS.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR REPORT.

Some jurisdictions do not allow limitation of liability for certain damages; in those cases our liability is limited to the maximum extent permitted by applicable law.

9. Acceptable Use

You agree not to:

• Submit websites containing illegal content
• Analyse websites you do not own or are not authorised to analyse
• Reverse-engineer our methodology or scoring algorithms
• Attempt to abuse, overload, or circumvent our systems
• Use the Service for any purpose that violates applicable law

10. Privacy

Your use of the Service is governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights.

11. Indemnification

If you are purchasing as a business (not as a consumer under applicable law), you agree to indemnify and hold harmless Audit&Fix from reasonable, documented claims and expenses directly arising from your material violation of these Terms or your infringement of third-party intellectual property rights. This clause does not apply to the extent prohibited by consumer protection law in your jurisdiction. If you are a sole trader or individual purchasing for mixed personal/business purposes, this clause applies only to the business portion of your use.

12. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia. Disputes shall be resolved in the courts of New South Wales. Before filing a lawsuit, you agree to attempt informal resolution by contacting us and negotiating in good faith for 30 days. Nothing in this clause affects any non-excludable rights you have under the consumer protection laws of your country of residence.

UK customers may also refer disputes to an alternative dispute resolution provider or the UK courts, in accordance with their statutory rights under the Consumer Rights Act 2015.

13. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new "Last Updated" date. Material changes will be communicated via email or a prominent notice on our website. Continued use after changes constitutes acceptance.

14. Termination

We reserve the right to refuse service to anyone for any lawful reason or to discontinue the Service at any time with reasonable notice. Outstanding orders will be fulfilled or refunded.

15. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to internet or hosting outages, third-party service failures, natural disasters, or government actions. We will use reasonable efforts to notify you and resume service promptly.

16. Severability & Entire Agreement

If any provision is found invalid or unenforceable, the remaining provisions remain in effect. These Terms and our Privacy Policy constitute the entire agreement between you and Audit&Fix regarding the Service. This clause does not exclude liability for pre-contractual statements made by Audit&Fix on which you reasonably relied.
